These Terms of Service ("Terms") constitute a legally binding agreement between you and Pharmnow, Inc. ("Pharmnow," "we," "us," or "our") governing your access to and use of the Pharmnow mobile application, website, and related services (collectively, the "Services").

Pharmnow is a medication delivery platform. We do not prescribe medications, provide medical advice, or replace the care of licensed healthcare professionals. Always consult your physician or healthcare provider before starting, stopping, or changing any medication.
All prescription medication orders require a valid prescription from a licensed healthcare provider. You agree that:
All prescriptions submitted are valid and legally obtained
You will only order medications prescribed specifically for you
You will provide accurate information about allergies and current medications
You understand that pharmacists may refuse to fill prescriptions based on professional judgment
Pharmnow connects you with independent, licensed pharmacies. The pharmacy, not Pharmnow, is responsible for:
Verifying prescription validity
Dispensing medications accurately
Providing medication counseling
Compliance with all pharmacy laws and regulations
When you place an order through our Services:
You are making an offer to purchase medications from the pharmacy
The pharmacy may accept or reject your order
Order confirmation does not guarantee fulfillment
Prices are subject to change without notice
You agree to:
Provide valid payment information
Pay all charges incurred under your account
Be responsible for any fees charged by your payment provider
Pay applicable taxes, delivery fees, and service charges
If you use insurance, you are responsible for:
Providing accurate insurance information
Any amounts not covered by insurance
Resolving insurance claim issues with your provider
Our delivery services are subject to the following conditions:
Delivery times are estimates and not guaranteed
You must be present to receive controlled substances
Valid identification may be required upon delivery
We are not liable for delays caused by weather, traffic, or circumstances beyond our control
Weather or traffic factors may impact delivery times
You may cancel orders before the pharmacy begins preparing them. Once dispensed, orders cannot be returned for refunds unless required by law.
Refund eligibility is determined by the pharmacy. Refunds generally cannot be provided for:
Medications that have left the pharmacy
Damaged or defective medication
Change of mind or change in prescriptions
Incorrect deliveries due to user error
We may provide promotional codes, discounts, or credits from time to time. You agree that:
Promotional codes have expiration dates and may be limited
Codes cannot be combined or stacked unless expressly permitted
Codes are not transferable or redeemable for cash
We reserve the right to cancel codes
We will provide full refunds only in cases of pharmacy error or defect
You agree not to:
Use the Services for illegal purposes
Submit false, fraudulent, or deceptive information
Attempt to obtain medications without valid prescriptions
Resell medications obtained through the Services
Use another person's account without permission
Interfere with proper functioning of Services
Upload viruses, malware, or other harmful code
Reverse engineer, decompile, or hack the Services
Scrape or data mine user information
Use bots, crawlers, or automated systems
Violate others' intellectual property rights
Harass or harm users through the platform
All content on the Services, including text, graphics, logos, icons, images, audio clips, digital downloads, data compilations, and software, are the property of Pharmnow or its content suppliers and are protected by applicable copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of the material on our Services, except as follows:
Your computer may temporarily store copies of such materials in RAM incidental to your accessing and viewing those materials
You may store files that are automatically cached by your web browser for display enhancement purposes
You may print or download one copy of a reasonable number of pages of the Services for your own personal, non-commercial use
THE SERVICES ARE PROVIDED ON AN "AS-IS" AND "AS-AVAILABLE" BASIS WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED OR ERROR-FREE.
TO THE FULLEST EXTENT PERMITTED BY LAW, PHARMNOW SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.
You agree to indemnify, defend, and hold harmless Pharmnow and our officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses, including without limitation reasonable legal fees, arising from:
Your use of the Services
Your violation of these Terms
Your violation of the rights of any third party
Any content you submit through the Services
Any dispute arising out of or relating to these Terms or the Services shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. You agree to waive any right to a jury trial or to participate in a class action lawsuit with other users of the Services.
We may terminate or suspend your account and access to the Services immediately, without prior notice or liability, for any reason, including but not limited to:
Breach of these Terms
Request from law enforcement or government agencies
Discontinuation or material modification of the Services
Unexpected technical or security issues
Extended periods of inactivity
We reserve the right to modify or replace these Terms at any time. We will notify you of significant changes by:

These Terms shall be governed by and construed in accordance with the laws of Nigeria, without regard to its conflict of law provisions. Any disputes shall be resolved in the courts located in Nigeria.
